New Clarification on Essential Construction Work From ESD

New Clarification on Essential Construction Work From ESD

UPDATE 3/30/20 12:00pm from ESD:

“Construction in support of essential businesses is permissible, but only with appropriate social distancing and cleaning/disinfecting precautions. If those cannot be met, the project should be postponed.”

The announcement on Friday March 27, 2020 of the redefinition of essential construction continues to be a gray area, while we at Cahill Strategies strive to ensure that our clients have the most up to date information regarding these regulations and restrictions.

Empire State Development has once again revised their guidelines and the new language is below:

“Local governments, including municipalities and school districts are allowed to continue construction projects at this time, as government entities are exempt from the essential business restrictions. However, to the greatest extent possible, local governments should postpone any non-essential projects and only proceed with essential projects when they can implement appropriate social distancing and cleaning/disinfecting protocols. Essential projects are those that have a nexus to the health and safety of building occupants or to support the broader essential services that are required to fulfill the critical operations of government or the emergency response to the COVID-19 public health crisis”

If you would like to apply for the Empire State Development waiver for projects to continue during this time please feel free to reach out to our team. Please do not hesitate to contact us at 212- 825-1205 or by email at cahill-construction-division@cahillstrategies.com should you have any questions concerning the guidelines or the ESD waivers.
