New York COVID-19 Construction Update March 22, 2020

We and our industry colleagues have received numerous questions concerning the language associated with the Essential Staff regulations that were outlined in the Governor’s Executive Order 202.6. We have been working relentlessly with our colleagues from all factions of the industry to gain clarity. This morning the NYS Empire State Development (ESD) has confirmed that all construction is deemed to be essential. Therefore ESD has stated that waivers for individual sites is not required at this time. As you can imagine ESD is inundated with the waivers currently and should you still wish to request a waiver please understand that it may be delayed due to the sheer number of waivers they are processing.

It is expected that the individual agencies will put out additional protocols and regulations to ensure that projects and sites are maintaining best practices for preventing and remediating the contamination of germs.
