Beginning November 14, 2022, applicants for permits for work that will disturb lead paint or paint of unknown lead content will be required to:

  • Provide an EPA lead firm paint certificate number
  • Attest that that the work complies with specific laws and regulations related to lead paint
  • Include information in the Tenant Protection Plan (TPP) related to lead paint.

Jobs Filed in DOB NOW: Build:

  • On the PW2, a new field has been added to the Applicant Information section to enter the EPA Lead firm certificate number, if applicable.
  • An attestation has been added to the Statements & Signatures, Applicant/Contractor Statement that the work complies with §27-2056.11 of the NYC Administrative Code and, where applicable, subpart E or subpart L of part 745 of title 40 of the Code of Federal Regulations, and, where applicable, the firm performing the work has filed or will file with the NYC Department of Health and Mental Hygiene a Notice of Commencement required by Administrative Code §27-2056.11(a)(2).
  • On the Tenant Protection Plan Request, a new section has been added in the Lead and Asbestos section to: provide information about whether the firm performing the work holds the certifications required to perform the work; provide the firm name and certification numbers; list any open violations related to lead issued by the NYC Department of Health and Mental Hygiene (DOHMH) or the NYC Department of Housing Preservation and Development (HPD), including the violation number, date issued, and City agency that issued the violation.

Jobs Filed in the Buildings Information System (BIS)

The PW2 and TPP1 forms have been updated to reflect the above changes. The updated forms dated Rev. 11/22, are available at nyc.gov/buildings. The PW2 dated (Rev. 3/22) and TPP1 dated (Rev. 5/20) forms will not be accepted after November 21, 2022.

TPP Notice to Occupants

The TPP Notice to Occupants in DOB NOW has been updated to include directions for obtaining information regarding the hazards associated with lead-contaminated dust. The permit applicant can print the notice after the permit is approved from the Filing Action column on the permit dashboard. For jobs filed in BIS, the updated TPP Notice to Occupants template is available at nyc.gov/buildings.
