On November 25, 2025, the NYC Department of Buildings (DOB) adopted amendments to Section 102-03 of the rules governing inspections and reporting for potentially structurally compromised buildings. These changes introduce new requirements for owners, registered design professionals (RDPs), and the reporting process for buildings impacted by events such as fire, collapse, or prolonged exposure to the elements.
Key Amendments
Expanded Inspection & Reporting:
- Owners must hire an RDP to conduct a critical examination and file initial, annual, and final reports for any building deemed potentially structurally compromised.
- Reports must include detailed findings, repair recommendations, photographs, site sketches, and corrective action timelines.
- All reports must be filed electronically with DOB.
Clear Definitions & RDP Responsibilities:
- The rule clarifies definitions for terms such as “acceptable report,” “critical examination,” and “diminished structural bearing.”
- RDPs are required to maintain records, insurance, and provide plans to correct unsafe conditions and monitor repairs.
Inspection Procedures:
- Critical examinations must assess all structural elements, including the roof, framing, walls, foundation, and appurtenances.
- Immediate hazards must be reported to DOB and the owner, with measures taken to safeguard the public.
- Reports must map and document all areas of distress and proposed corrective actions.
Filing Deadlines & Penalties:
- Initial, annual, and final reports are required for each affected building.
- Failure to file an acceptable initial or annual report: $1,500 per month (1- or 2-family) or $3,000 per violation (all others).
- Failure to file a final report: $5,000 per year.
- Additional penalties apply for failure to maintain building stability.
Waivers & Challenges: Owners may challenge penalties or request waivers for new/government ownership, bankruptcy, demolition, or vacate/seal orders by submitting supporting documentation.
Compliance Actions
- Review your building’s status and ensure timely engagement of a qualified RDP.
- Prepare for electronic filing of all required reports and documentation.
- Maintain ongoing records and be proactive in addressing unsafe conditions.
