Construction Case Study: Violation Review and Resolvement
Challenge:
A GC received more than $330,000 in defaulted violations from the FDNY, NYPD, DEP, DOT, and DOB from the NYC Department of Finance. The client wanted to settle the violations as timely and economically as possible, without the outstanding fines impacting their GC license.
Solution:
Our team determined which violations needed to be paid as part of an immediate settlement agreement with the DOF, and which violations could be challenged in EBC OATH.
Result:
The NYC DOF offered a fair and immediate settlement agreement for the violations we chose not to appeal. The remainder of the violations we challenged in ECB OATH, where many were dismissed based on evidence, with several pending appeals.
