The NYC Department of Buildings (DOB) has officially adopted an amendment to the rules regarding artwork on temporary protective structures. This final rule is now in effect and applies to contractors, property owners, and construction managers across New York City. The update aims to clarify compliance standards, inspection requirements, and opt-out procedures under Section 3307 of the NYC Building Code.

Key Updates You Need to Know:

  • Effective Immediately – The final rule is now in effect as of publication and applies to all temporary protective structures installed on or after September 1, 2023.
  • Artwork Requirements – Sidewalk sheds, construction fences, and supported scaffolds must include DOB-approved artwork unless the property owner has formally opted out in compliance with the rule.
  • Opt-Out Restrictions – City-owned properties or projects receiving City capital funding cannot opt out of the artwork requirement unless explicitly exempted under Section 3307.11.7.1.
  • Installation Guidelines – Artwork may be either painted or affixed directly to the protective structure. The installation method must align with the structure type and location.
  • Inspection Provisions – Painted artwork is exempt from routine DOB inspections. However, affixed artwork (such as printed panels) is subject to inspection per existing Building Code intervals:
    • Daily (sheds)
    • Weekly (fences)
    • Per shift (scaffolds)

The DOB’s goal is to enhance public-facing construction environments while ensuring clear, safe, and aesthetically improved job sites.
