Updated: December 17, 2024
The Department of Buildings (DOB) has updated its rules regarding energy efficiency and reporting for buildings in New York City. This includes guidelines for energy audits and the qualifications of energy auditors.
The updated regulations outline the necessary certifications required for professionals conducting these audits and set forth requirements for the submission of Energy Efficiency Reports (EERs). The revisions aim to streamline compliance with NYC’s energy efficiency laws, offering clearer qualifications for auditors and adjusting penalties related to the timely submission of EERs.
- Energy Management Professional Certification Added: The Energy Management Professional Certification, offered by the Energy Management Association, is now recognized as an acceptable qualification for energy auditors, expanding options for qualified professionals.
- Penalty Rule Modification: The provision requiring payment of outstanding penalties before accepting new Energy Efficiency Report (EER) submissions has been removed. While penalties can still be enforced, this change allows buildings to submit reports and work toward compliance without prior penalty resolution.
These updates aim to enhance consistency in enforcement and provide greater support for buildings striving to meet energy efficiency requirements.

Cahill Strategies Construction Solutions Guide to NYC Building Code Chapter 33 Revisions
Cahill Strategies has developed a detailed and documented guide to the most important revisions that New York construction professionals are likely to encounter every day. We were able to do this because Cahill Strategies has been involved instrumentally in the development of these codes.
The 100-page book is meticulously organized and can be used as a handy reference when many common issues arise. In each section, the specific revisions are highlighted, and the new information is presented in a clear and practical manner with further explanation on why the change is so important. All of this, reviewed and vetted by one of New York’s longest serving, former DOB professionals – Cahill Strategies’ Director of Construction Code & Safety, Bobby D’Alessio.
