1. 2022 Construction Codes: Revised PW1 Plan/Work Application Form
The PW1: Plan/Work Application form has been updated to include the 2022 Construction Codes. The new form will have the following changes and additions.
2. NYC DOB Announces Buildings After Hours Cancelled at Brooklyn Borough Office Tuesday, November 22nd
Buildings After Hours is cancelled on Tuesday, November 22, 2022, at the Brooklyn Borough Office only. Buildings After Hours will take place in all other borough offices from 4:00 to 7:00 pm.

3. And Introducing BC 3303.14.5 – Dewatering
Some specific requirements have been added to the code related to dewatering operations during soil or foundation work. The general mandate is to protect all property and structures potentially affected by the drawdown of the water table and to monitor the drawdown operation, as well as monitor adjoining property for movement. The dewatering plan must be developed by a licensed design professional.

A Note About the effective dates of the 2022 New York City Building Code, Chapter 33, Safeguards During Construction or Demolition:
- The effective date of the 2022 Building Code (Local Law 126 of 2021) is November 7, 2022.
- Buildings Bulletin 2022-007 (Building Bulletins 2022 – Buildings governs when an application is subject to the 2022 codes vs prior codes.
- For Chapter 33/Safeguards During Construction or Demolition, the trigger date for jobs requiring a Site Safety Plan (SSP) is the approval date of the SSP.
- For jobs NOT requiring a SSP submission or not requiring a SSP at all, the trigger date is the submission date of the underlying work application (new building, alteration, etc).
- For phased SSP submissions, at least one complete phase (such as the foundation phase of a multi-phase project) must be approved before 11/07/22 to vest under the 2014 codes.
- Application submissions must be “substantially” complete, meaning, no incomplete “place holder” filings should be submitted for the sole purpose of vesting under a prior code.
- For temporary construction equipment, including fences, sidewalk sheds, scaffolds, cranes, chutes, etc., the trigger date is the date of submission of the temporary construction equipment application.

NYC’s 2022 Chapter 33 Construction Code Revisions – BC 3304.7 – Access to Excavations
The existing code required at least one means of egress from general open-cut excavations. The revision incorporates the OSHA requirement for multiple means of ingress/egress for trenches (trench definition: 4 feet or greater in depth and 15 feet or less in width) greater than 25 feet in length.
NYC’s 2022 Chapter 33 Construction Code Revisions – BC 3304.4.4 – Guardrail System
A common-sense guardrail exemption has been added to the revised code, allowing an adequate cover to be used in lieu of guardrails for wells, pits, shafts, or similar excavation.
NYC’s 2022 Chapter 33 Construction Code Revisions – BC 3304.4.1 Support of Excavation Construction Documents
The existing code allowed any registered design professional to prepare support of excavation drawings. The revised code allows only a registered professional engineer to prepare support of excavation drawings where the excavation will be carried to depth greater than 20 feet.
NYC’s 2022 Chapter 33 Construction Code Revisions – BC 3303.16 Worker Sheds, Contractor Sheds, and Similar Structures
The revised code now requires the installation of smoke detectors and wet sprinklers or dry chemical extinguishers (commonly used today) and compliance with egress requirements of Chapter 10, as they relate to door width and travel distance.
NYC’s 2022 Chapter 33 Construction Code Revisions – BC 3303.4.11 Daily Inspection of Housekeeping
The revised code has added a daily inspection requirement for general housekeeping to ensure compliance with 3303.4.1 through 333.4.10.
