The New York City Department of Environmental Protection (DEP) has adopted an amendment to the Citywide Construction Noise Mitigation Rules that will require noise monitoring at qualifying large-scale construction sites. The rule takes effect April 21, 2026.
Who Does This Apply To?
The rule is not a blanket requirement. It applies specifically to new building construction projects that meet all four of the following criteria:
- The project requires an Alternative Noise Mitigation Plan (ANMP) for after-hours construction work.
- The project duration is 30 days or longer — consecutive or non-consecutive days count toward the total.
- The building’s gross floor area is 200,000 square feet or more, as defined in Section 202 of the Building Code.
- The construction site is within 50 feet of a residential receptor.
What Is Required If Your Site Qualifies?
If your project meets all of the above criteria, at least one noise monitoring device must be installed on site, positioned to face the nearest sensitive or residential receptor, whichever is closer. Monitoring must begin at the outset of the project and continue 24 hours a day until construction activities are limited to both minimal noise impact work and interior renovation work, as defined under the applicable rules.
ANMP Application Requirements
The ANMP application must include a map — drawn from the Department of City Planning’s ZoLa Map — identifying all sensitive and residential receptors within a 75-foot radius of the site, along with the proposed location of monitoring devices. The application must also provide the number and locations of devices and the responsible party’s name and contact information.
Two categories are exempt from the rule: projects in which all dwelling units qualify as affordable housing units as defined in Section 26-2201 of the Administrative Code, and emergency construction work as defined under the Administrative Code.
Device Specifications
- Be mounted 8–10 feet off the ground, on a wall or pole.
- If wall-mounted, the outdoor microphone must be positioned at least one foot away from the nearest surface to prevent sound reflection.
- Be equipped with a weatherproof, outdoor-rated microphone that meets or exceeds Class 2 standards per IEC 61672-1
- Record sound levels in A-weighted decibels (dBA)
- Capture Lmax readings over five-minute sampling intervals.
- Transmit data — including location, decibel readings, and timestamps — to DEP via a designated public API at least once per hour.
Windscreens must be inspected monthly and replaced if damaged. DEP may also publish an Approved Devices list on its website to help responsible parties identify compliant equipment.
The Bigger Picture
The rule does not establish new noise limits or penalties on its own. Rather, it creates a real-time data reporting mechanism that equips DEP with accurate, continuous sound level information. That data will be used to determine whether existing noise thresholds under an ANMP are being met — and to inform decisions about whether additional mitigation measures or adjusted working hours are warranted.
