The NYC Department of Buildings (DOB) has proposed an amendment to the rules relating to potentially structurally compromised buildings. This update impacts NYC building owners, architects, engineers, and contractors by introducing new inspection procedures, report requirements, and penalties for non-compliance. The goal: increased structural safety and streamlined oversight under Article 217 of the NYC Administrative Code.
Key Updates You Need to Know:
- Public Hearing Scheduled – A virtual public hearing on the proposed rule will be held at 11:00 AM on May 29, 2025.
- Comment Submission Deadline – Written comments must be submitted by May 29, 2025 via email (dobrules@buildings.nyc.gov), mail, or through the NYC Rules website: rules.cityofnewyork.us
- Inspection & Reporting Requirements – New definitions and responsibilities for Registered Design Professionals (RDPs) have been outlined. Affected buildings will now require:
- Initial Report within 60 days of becoming compromised
- Annual Reports every year until deemed structurally stable
- Final Report when all unsafe conditions have been corrected
- Civil Penalties Introduced – Fines for failure to file reports include:
- $1,000/month for missing initial or annual reports
- $5,000/year for failure to file a final report within 2 years
- Waivers & Appeals – New rules clarify how owners may challenge or seek waivers of civil penalties due to ownership change, demolition, or extenuating circumstances.
