NYC Department of Buildings (DOB) has adopted a final rule amending DOB’s rules related to parking structure compliance reports and facade inspection reports (FISP). The update is most relevant for building owners, property managers, and engineers responsible for maintaining compliance with NYC Administrative Code requirements for exterior walls (facades) and parking structures. 

Articles 302 and 323 of Title 28 of the New York City Administrative Code require inspection, maintenance, repair, and reporting of conditions for building facades and parking structures, respectively. DOB’s final rule updates the fee schedule and adds new fee items tied to processing, inspections, and certain requests.

Key changes

Updated fees for Facade Inspection Reports (FISP)

  • DOB’s fee schedule for facade inspection reports includes:
    • Initial filing: $425
    • Amended/subsequent filing: $425
    • Application for extension of time to complete repairs: $305
    • Request for waiver of penalties: $140

Updated fees and new fee items for Parking Structure Compliance

  • DOB’s fee schedule for parking structure compliance reports includes updated fees for initial, amended/subsequent, and extension filings (per DOB’s fee table), and adds new fee items including:
    • Inspection made necessary by failure to file required parking structure compliance report: $575
    • Parking Structure Verification Request: $685
    • Parking Structure Partial Protection Removal Request: $695
    • Request for waiver of penalties: $140

Process clarifications for parking structures (repairs, requests, and resubmittals)

The rule also adds and clarifies procedural requirements, including:

  • New request types defined:
    • Verification Request: A request submitted by the QPSI or building owner to verify that a parking structure is subject to periodic inspection under the rule.
    • Partial Protection Removal Request: A request submitted by the QPSI to remove public protection from only a section of a building classified as “unsafe,” after work to correct the unsafe condition on that section is complete.
  • Post-repair inspection and amended filing timing:
    • Within two weeks after repairs to correct an “unsafe” condition are completed, the QPSI must inspect and promptly file an amended report (fees apply).
  • Administrative completeness and resubmittal timing:
    • Where a report is deemed administratively incomplete, DOB requires a revised report to be filed within the timeframes described in the rule.
  • Penalty waiver submission method:
    • Requests for a waiver of penalties must be submitted through DOB’s website, with the filing fee and required supporting documentation.

Recommended next steps

  1. Confirm your current FISP and parking structure compliance filing status.
  2. Budget for updated filing fees and potential request fees (extensions, waivers, verification requests).
  3. If you anticipate closeout of repairs tied to an “unsafe” condition, plan ahead for the two-week post-repair inspection requirement and amended filing timing.
  4. If you need to confirm whether a parking structure is subject to periodic inspection, consider whether a Verification Request is appropriate.
